Welcome to Monarch & Marigold Co. This website and store are operated by Crimson Ink Adventures, LLC, a Colorado limited liability company doing business as Monarch & Marigold Co. Throughout these terms, “we,” “us,” and “our” refer to Crimson Ink Adventures, LLC.

These Terms of Service, together with our Shipping and Returns policy and our Privacy Policy, describe your rights and responsibilities when you use this site and when you buy from us. Please read them, as they include important information about warranty disclaimers and limitations of liability.

By visiting or using this site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the site.

This store is powered by Shopify, which provides the technology that allows us to offer these services to you.

1. Using this site

By agreeing to these Terms, you confirm that you are at least the age of majority in your state of residence, and that you have consented to any minor dependents using this site on devices you own or manage.

To place an order you may be asked for information such as your email address, billing address, payment details, and shipping address. You agree that the information you provide is accurate and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, or assign your account to anyone else.

2. Our products

We have made every effort to represent our products accurately. Please note that colors and appearance may look different on your screen depending on your device and its settings.

Spirit Guides are one of a kind. Each alebrije is carved and painted by hand by artisans in Oaxaca, Mexico, and each one is photographed individually. The Spirit Guide you receive is the exact piece shown in its listing. No two are alike, and once a Spirit Guide is adopted, that piece leaves the collection and will not be recreated.

Small variations in carving, brushwork, and color across the collection are inherent to handmade folk art and are part of what makes each piece its own. Colors may appear differently on your screen than in person, depending on your device.

Jewelry is described with the materials and stones as supplied to us by our partner workshop. Natural stones vary in color, pattern, and inclusion.

Symbolism, not claims. Where we describe stones, symbols, or traditions, we do so as matters of cultural meaning and personal significance. Nothing on this site is intended as a claim about physical, psychological, or spiritual effects, and nothing here is medical advice.

Product descriptions and availability may change at any time without notice. We may limit quantities or decline to sell to any person or region at our discretion.

3. Orders

When you place an order you are making an offer to purchase. We may accept or decline any order at our discretion, and your order is not accepted until we confirm it. We must receive and process payment before an order is accepted.

Because Spirit Guides are one of a kind, availability is not guaranteed until your order is confirmed. If a piece sells while your order is being processed, we will contact you and issue a full refund or help you choose another.

Please review your order before submitting it. We may not be able to accommodate cancellation requests once an order has been accepted.

Your purchases are subject to our Shipping and Returns policy.

You confirm that your purchases are for your own personal or household use and not for commercial resale.

4. Prices and payment

Prices and promotions may change without notice. The price charged will be the price in effect when your order is placed, as shown in your order confirmation. Posted prices do not include taxes or shipping unless stated.

You confirm that the payment information you provide is accurate, that you are authorized to use the payment method, and that you will pay all charges at the posted prices, including shipping and applicable taxes.

5. Shipping and delivery

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers or by events outside our control. Once we transfer a package to the carrier, title and risk of loss pass to you.

6. Travel content and affiliate links

Our Journeys pages describe travel experiences in Mexico and include links to third-party booking platforms. Some of these are affiliate links, which means we may earn a small commission if you book through them, at no additional cost to you.

We do not operate, sell, or provide any travel experience. All bookings are made directly with the third-party operator, under that operator’s own terms. We are not responsible for the quality, safety, availability, or cancellation of any travel experience, and any issue with a booking should be raised with the operator directly.

Travel information on this site is offered for inspiration and general interest. It is not advice about safety, health, entry requirements, or insurance. Please do your own research before you travel.

7. Intellectual property

Monarch of the Heart, the Monarch & Marigold Co. name and logo, and all text, images, designs, and other content on this site are owned by Crimson Ink Adventures, LLC or its licensors, and are protected by United States and international copyright and trademark law.

You may use this site for your personal, non-commercial use. You may not reproduce, distribute, modify, republish, or transmit any material from this site without our prior written permission. Nothing in these Terms grants you a license to any of our trademarks.

Photographs of Spirit Guides remain the property of Crimson Ink Adventures, LLC and the artisan workshop that created the pieces.

8. Third-party links and tools

This site may link to or embed content and tools operated by third parties. We do not control them, we do not review them, and we provide access to them without warranty of any kind. If you leave this site to use them, you do so at your own risk and under their terms. Questions or complaints about a third party’s products or services should be directed to that third party.

9. Relationship with Shopify

This store is powered by Shopify, which enables us to provide these services to you. However, any sale you make is made directly with Crimson Ink Adventures, LLC. Shopify is not responsible for any aspect of a sale between you and us, including any injury, damage, or loss resulting from products purchased. You release Shopify and its affiliates from all claims arising from your transactions with us.

10. Privacy

All personal information collected through this site is subject to our Privacy Policy. Because the site is hosted by Shopify, certain information is also subject to Shopify’s privacy policy. By using this site you acknowledge that you have read both.

11. Reviews, feedback, and submissions

If you send us a review, comment, idea, suggestion, or other content, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display it in any medium, including for promotional purposes.

You confirm that you own or have the rights to anything you send us, that you have disclosed any compensation or incentive you received in connection with it, and that it does not infringe anyone’s rights or contain unlawful, abusive, or misleading material.

We are not obliged to keep submissions confidential, to pay for them, or to respond to them. We may remove any submission at our discretion.

12. Errors and omissions

There may occasionally be information on this site containing typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping, or availability. We may correct errors and change or update information at any time without prior notice, including after an order has been submitted.

13. Prohibited uses

You may use this site for lawful purposes only. You may not use it to break any law, to infringe anyone’s intellectual property, to harass or harm any person, to transmit false or misleading information, to send unsolicited advertising, to impersonate anyone, to upload malicious code, to collect other people’s personal information, or to interfere with the site’s security or operation.

You may not use automated tools, scrapers, or data extraction methods to access this site without our written permission.

We may suspend or terminate access at any time if we determine these Terms have been violated.

We may terminate this agreement or your access to the site at any time at our discretion. You remain liable for any amounts owed up to the date of termination.

17. Indemnification

If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed. The remaining provisions stay in effect.

19. Waiver and entire agreement

Our failure to enforce any provision of these Terms is not a waiver of that provision. These Terms and any policies posted on this site constitute the entire agreement between you and us, superseding any prior agreements or communications.

You may not transfer or assign these Terms or your rights under them without our written consent. We may assign them without notice.

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. You and Crimson Ink Adventures, LLC consent to venue and personal jurisdiction in the state and federal courts located in Colorado.

You can review the current version of these Terms on this page at any time. We may update or replace any part of them by posting changes here. Your continued use of the site after changes are posted constitutes acceptance of those changes.
